Terms of Use (End User License Agreement) — TMS Mobile App

These Terms of Use ("EULA") govern the use of the TMS mobile application (the "App") provided by TEKNOLİKYA ("TMS"). By downloading or using the App you accept these terms.

1. Business use. The App is for authorised users of travel agencies and tourism businesses that hold a subscription agreement with TMS. Your right to use the App is subject to that subscription agreement and ends when it terminates or when your business closes your account.

2. License. You are granted a limited, non-exclusive, non-transferable, non-sublicensable right to use the App solely for the commercial activities of the business you work for.

3. Prohibited use. Using the App for unlawful purposes; reverse engineering or attempting to access source code; attempting to access other customers' data; circumventing security measures; sending unsolicited commercial messages; renting out or reselling the App — are all prohibited.

4. Account security. You are responsible for keeping your credentials confidential; actions taken through your account are attributed to you and your business. Report suspected unauthorised use immediately.

5. Data. Processing of personal data is described in the Privacy Policy. Business data entered into the App belongs to the business you work for.

6. Intellectual property. The App, its design, trademarks and all components belong to TMS or its licensors; this EULA grants you no ownership rights.

7. Updates. TMS may update the App and add or remove features; security updates may be required.

8. Liability. The App is provided "as is"; uninterrupted or error-free operation is not guaranteed. To the extent permitted by mandatory law, TMS is not liable for indirect damages; the liability provisions of the subscription agreement with your business remain applicable. Nothing in this section limits mandatory consumer rights.

9. Termination. Your access may be suspended or terminated if you breach this EULA.

10. Store terms. If you obtained the App from the Apple App Store: this EULA is between you and TMS only; Apple is not a party and has no maintenance or support obligation; Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you upon your acceptance. If obtained from Google Play, the Google Play Terms of Service also apply.

11. Governing law. This EULA is governed by Turkish law; the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction, without prejudice to mandatory consumer jurisdiction rules.
